Times are changing, sometimes for the worse, sometimes for the better. New challenges force old systems to adapt or get out of the way. In this case, the linked article describes an ongoing legal case filed in the Western District of Louisiana, vaccine injured individuals are arguing that the current Health and Human Services program for addressing COVID vaccine injuries is depriving them of their right to a jury trial and due process. This seems to stem from the fact that 11,000 lawsuits have been filed so far but just a little over 1,000 claims had been judged as of the November 2023 publication of the referenced article.
Without getting into all the legal details, many are arguing that this newest so-called vaccine should be incorporated into the current VCIP (Vaccine Compensation Injury Program) active for years. The COVID vaccine is currently covered under Countermeasures Injury Compensation Program which was designed for the Ebola and Anthrax scares of past years. On the other hand, the VCIP is the normal path for someone with an alleged vaccine injury to file when looking for consideration of compensation for harm from a vaccine. It functions somewhat like an insurance program run by the federal government in which the vaccine producers pay into the program and the federal government judges cases on their merit without any further remuneration from the vaccine producers. So far, it has ruled in favor of the COVID vaccine injured in only 6 cases. The majority addressed have been dismissed for missing filing deadlines of some sort (1,235).
The VCIP is not without its share of problems, so such a simple shift does not solve all the problems. The VCIP has its own set of lawyers and processes. I am not confident that they could handle such an influx of COVID vaccine related cases either. The other issue is that the process of adding vaccine to the VCIP list usually takes 2 years and requires for Congress to assign an additional tax to the vaccine producers for covering this so-called vaccine. They would also have to hire more lawyers and support to handle this influx of cases.
Regardless, many have been injured and many have not been granted their time in court. Our government is failing those it convinced or forced to receive an experimental vaccine. When will the public realize that we are not in Kansas anymore?
